MID Devon District Council is continuing to investigate a number of complaints regarding an odour in the Tiverton area.

The Council has received multiple complaints about a smell affecting parts of Tiverton, the cause of which is still being determined.

To support officers resolve the matter residents affected are being asked to complete diary sheets until the end of the month.

Under the Environmental Protection Act 1990, any nuisance must be materially impacting the enjoyment of someone’s property and evidenced as such.

The diarised log sheets should contain the dates and times, and any other evidence relating to the issue, and should only be returned back to the Council at the end of the month.

The diary sheets should also contain the type of smell and the impact the odour is having on the enjoyment of their property.

This will help the Council to look more specifically at the activities that may be causing the problem.

Residents should not call the Council each time they experience the odour as the Council is unable to look at the occurrences in isolation.

Cllr David Wulff, Cabinet Member for Cabinet Member for Quality of Living, Equalities and Public Health said: “We appreciate how unpleasant this is for those residents who are affected.

“Our officers are working hard to find the cause and a solution, but we need evidence to help with our investigations.

“We have been liaising with other agencies and hope to find a solution soon. In the meantime I would encourage residents to heed our advice and complete the diary sheet.”

Anyone affected by the issue can also download nuisance diary sheets from our website: Bonfires and smoke nuisance - MIDDEVON.GOV.UK or request one via phone or email.

Residents should send the completed diary sheets to: [email protected]
